1. Acceptance of Terms

By accessing or using mealplan.fit ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including nutrition professionals ("Professionals") and their clients ("End Users").

2. Description of Service

mealplan.fit is a practice management platform designed for registered dietitians, nutritionists, and other nutrition professionals. The Service provides tools for:

• Creating and managing personalized diet plans for clients
• Tracking client progress and vitals
• Managing appointments and consultations
• Generating PDF meal plans and reports
• AI-powered recipe suggestions
• Client portal for self-service access

3. User Accounts and Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

4. Subscriptions and Payments

Free Trial: New users receive a limited free trial period. After the trial expires, a paid subscription is required to continue using premium features.

Billing: Subscription fees are billed in advance on a monthly or yearly basis. Payment is processed through Razorpay, a third-party payment processor. By providing payment information, you agree to Razorpay's terms of service.

Refunds: Subscription fees are generally non-refundable. However, you may cancel your subscription at any time, and it will remain active until the end of the current billing period.

Price Changes: We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.

5. User Content and Data Ownership

Your Content: You retain all rights to the content you create, upload, or store on the Service, including client information, diet plans, recipes, and notes ("User Content").

License Grant: By using the Service, you grant us a limited license to host, store, and display your User Content solely for the purpose of providing the Service to you.

Client Data: As a Professional, you are the data controller for your clients' personal information. You are responsible for obtaining appropriate consent from your clients for data collection and processing.

Data Export: You may export your data at any time through the Settings page. Upon account deletion, we will delete your data in accordance with our Privacy Policy.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEALPLAN.FIT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any health outcomes or medical conditions resulting from dietary advice provided by Professionals using the Service
• The accuracy, completeness, or reliability of any nutrition data, calculations, or AI-generated content
• Actions or omissions of third parties, including payment processors
• Service interruptions, data loss, or security breaches beyond our reasonable control

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless mealplan.fit and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any claims by your clients related to services you provided
• Any content you upload or create through the Service

9. Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by mealplan.fit and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Upload malicious code, viruses, or harmful content
• Harvest or collect user information without consent
• Use the Service to spam or send unsolicited communications

11. Termination

By You: You may terminate your account at any time by using the account deletion feature in Settings or by contacting us at support@simpleapps.world.

By Us: We may suspend or terminate your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. Data deletion will be handled in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana, India.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
